Terms of Service

Welcome to Anubis. This Terms of Service ("Agreement") constitutes a legally binding contract between you (the "User", "Member", or "Customer") and Anubis development team ("we", "us", or "our"). This Agreement governs your access to and use of Anubis Discord bot, Anubis.bot website (the "Site"), and all associated tools, APIs, and services (collectively, the "Service").

By adding the Bot to a Discord guild (server), interacting with its commands, clicking "I Agree," or continuing to use any part of the Service, you acknowledge that you have read, understood, and agreed to be bound by the terms of this Agreement. If you represent a server or organization, you warrant that you have the legal authority to bind that entity to these terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM USING THE SERVICE AND MUST IMMEDIATELY REMOVE THE BOT FROM ALL SERVERS UNDER YOUR CONTROL.

The Service is intended solely for users who are thirteen (13) years of age or older. We do not knowingly collect information from individuals under the age of 13. By using the Service, you represent and warrant that you are at least 13 years old. If you are under the age of 18 but at least 13, you represent that your parent or legal guardian has reviewed and agreed to these terms on your behalf.

Furthermore, you represent that you have not been previously suspended or removed from the Service and that your use of the Service is in compliance with all applicable local, state, national, and international laws and regulations.

Anubis allows users to create and store content, such as custom commands, automod configurations, and welcome messages ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the Service.

By creating User Content, you grant Anubis a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, store, display, reproduce, and distribute your User Content solely for the purposes of operating and providing the Service to you and your server.

We reserve the right, but are not obligated, to remove or modify User Content for any reason, including User Content that we believe violates these Terms or our internal safety policies.

The Service may include a virtual economy consisting of virtual currency, points, levels, and digital collectibles ("Virtual Goods"). These Virtual Goods are provided for entertainment purposes only. You acknowledge and agree that Virtual Goods have no "real-world" monetary value and cannot be exchanged for fiat currency or any other item of tangible value from us or any other party.

We reserve the absolute right to manage, regulate, control, modify, and/or eliminate Virtual Goods as we see fit. We shall have no liability to you or anyone else for the exercise of such rights. Possible reasons for Virtual Goods modification include, but are not limited to, balance patches, database resets, technical migrations, or evidence of exploitation/cheating.

LOSS OF DATA: In the event of a technical failure, server migration, or data corruption, Anubis is not responsible for the loss of Virtual Goods or progression data.

We may offer specific features or enhancements as a paid subscription ("Premium"). By purchasing Premium, you agree to pay the fees associated with the subscription tier you select.

Tier Availability: We reserve the right to change the features included in any Premium tier or to discontinue a tier entirely at any time. Significant changes to subscription benefits will be announced in our official Discord community.

Refunds: EXCEPT AS REQUIRED BY APPLICABLE LAW, ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. We do not provide refunds or credits for any partial subscription periods or unused features.

The Service, including the Bot's logic, code, assets, branding, logo, and website content, is the exclusive property of Anubis and its licensors. You are granted a license to use it as described in Section 3, but this does not constitute a transfer of ownership.

Unauthorized use of our trademarks, logos, or copyrighted code is strictly prohibited and may result in legal action. You agree not to copy, distribute, modify, or create derivative works of the Service without our express prior written consent.

The Service relies on the Discord API and may integrate with other third-party services (e.g., YouTube, Twitch, Spotify). Your use of these integrations is subject to the respective third-party's terms and privacy policies. We are not responsible for the content, privacy, or practices of any third-party service.

You agree to defend, indemnify, and hold harmless Anubis and its developers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Global Ban Policy: Severe violations (raiding, doxing, malicious exploits) will result in a "Global Ban." This entails a permanent blacklist of your User ID and all servers you own from accessing Anubis across the entire Discord platform.

You agree that any dispute arising out of or related to these Terms or the Service will be resolved through final and binding arbitration, rather than in court. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the lead developer resides, without regard to its conflict of law provisions.
